LIHUE — A Kekaha man was sentenced to probation and a month in jail for work-related sexual assaults on Thursday in 5th Circuit Court.
Jerry Agbayani Pascua, 31, was sentenced to five years with the HOPE (Hawaii’s Opportunity Probation with Enforcement) for close supervision of high-risk offenders. He must also spend 30 days in jail in addition to time already served, and be listed with the state sex offender registry.
Pascua was arrested on April 11, 2012, for third-degree sexual assault and two counts of fourth-degree sexual assault. He pleaded no contest to one count of felony third-degree sexual assault on Dec. 10, 2013.
Chief Judge Randal Valenciano said the case involves multiple incidents that occurred in the workplace over a period of time.
When the victim did not report the early offenses, the defendant was “somewhat emboldened” to continue on with more involved and inappropriate behavior.
Private attorney Craig De Costa said the defendant has received counseling for the underlying issues related to impulse issues and shows considerable remorse for the victim.
County Deputy Prosecuting Attorney Lisa Arin said the victim was embarrassed and traumatized.
