LIHUE — A law that went into effect this month may see its first case in 5th Circuit Court.
Seth Malamapono Dick, 34, of Koloa, was arrested at 11:30 p.m. July 2 and charged with physically abusing a female household member.
County Deputy Prosecuting Attorney Gary Nelson filed a felony complaint July 9. The felony information complaint said the offense occurred in the presence of a child under the age of 2 years old.
Gov. Neil Abercrombie on June 20 signed House Bill 1993 into law, making an act of physical abuse in the presence of a family or household member under the age of 14 a class C felony. A class C felony has a maximum penalty of five years in prison and a $10,000 fine.
Dick entered a not guilty plea at his arraignment in 5th Circuit Court July 10. He is being held at Kauai Community Correctional Center on $5,000 bail.
A jury trial is set for Nov. 17.
