LIHUE — A Kilauea man was sentenced to five years in prison after losing his probation on a 2010 drug charge conviction on Thursday in 5th Circuit Court.
Justin Mark Hennessy, 37, admitted to using methamphetamine and Oxycodone. Chief Judge Randal Valenciano granted the state’s motion for revocation of Hennessy’s HOPE (Hawaii’s Opportunity Probation with Enforcement) program for close supervision of high-risk offenders.
County Prosecuting Attorney Justin Kollar said the state recommended the five-year prison term. The defendant has failed three treatment centers and has had seven probation violations in two years.
“The court has extended multiple opportunities to the defendant and unfortunately he has not taken advantage of these opportunities,” Kollar said in court. “We would prefer to have these resources available for people who want to change their lives.”
Deputy State Public Defender John Calma said Hennessy had been doing well. He was employed and his outpatient treatment for addiction therapy had been reduced to one day a week.
The first anniversary of the death of his father led to a relapse that he admitted to his probation officer, Calma said. He wants to continue treatment with another chance at probation.
“I agree with the state, Mr. Hennessy,” Valenciano said.
Hennessy was sentenced to time served and a five-year felony probation for first-degree promotion of a detrimental drug, third-degree promotion of a dangerous drug, and drug paraphernalia on Sept. 29, 2011. He was placed in the HOPE probation program on June 19, 2012, and a revocation motion was filed by the state after several violations.
