LIHUE — A Kapaa man was given 60 days jail on Tuesday in 5th Circuit Court.
Tumua Tuingafue Masaniai Jr., 20, will get a chance to clear his record because the court granted a motion for deferred acceptance of a no contest plea. If he completes his probation, the charges can be removed from his criminal record.
“I will give you that chance,” said Chief Judge Randal Valenciano.
Masaniai will also have to pay $5,844.59 in restitution to the victims. He was ordered to undergo a substance abuse evaluation and take an anger management class.
County Deputy Prosecuting Attorney Melinda Mendes represented the state. The criminal complaint noted that on Dec. 21, 2012, Masaniai entered a vehicle without permission, damaged property in the amount of $500 and caused bodily damage to two individuals.
Represented by defense attorney Alan Okomoto, Masaniai changed his plea on July 1 to first-degree unauthorized entry, second-degree theft, amended third-degree robbery, resisting arrest, and first-degree terroristic threat.
He also pleaded to two counts of third-degree assault in a second case.
