LIHUE — A Koloa man convicted of methamphetamine possession was sentenced to five years in prison on Thursday in 5th Circuit Court.
In his statement to the court, Christian Michael Nigg, 21, said his crimes had something to do with meth and he regretted ever touching the drug. He apologized to his victims, their families, as well as his own family for the pain he caused them.
“It was not my intention to harm anyone,” Nigg said. “My goal now is to better myself for my family.”
Nigg was also sentenced to a concurrent one-year jail term for a misdemeanor resisting arrest conviction.
Chief Judge Randal Valenciano informed Nigg the court had no other option than the five-year prison term with a mandatory minimum sentence of one year and eight months before being eligible for parole.
Valenciano said he was disappointed to see Nigg in court again. He was a co-defendant in a case involving beating and robbing people at Poipu Beach Park in 2012.
In the latest case, Nigg was inside the fenced yard at a home of a family he had no relationship with — although the petty misdemeanor trespass charge was later dropped from the complaint with no proof he entered the home. The homeowners called police after witnessing Nigg committing a sexual act and he was found in possession of methamphetamine.
After committing violent crimes in the 2013 case, Valenciano said the court was concerned about the escalation of new crimes that included lewd sexual acts.
“You have a lot of fixing to do before the court can consider you safe for the community,” Valenciano said.
County Deputy Prosecuting Attorney Melinda Mendes said the indecent exposure charge was dropped as part of a plea agreement. She asked the court for the prison term with the mandatory minimum.
State Deputy Public Defender Samuel Jajich represented Nigg. He said the mandatory minimum limited the ability to argue sentencing, but added Nigg took responsibility as a young man who wants to turn his life around.
Nigg will get credit for nearly six months already served in jail. He has been held at Kauai Community Corrections Center since his arrest on July 25.
