LIHUE — A jury was unable to reach unanimous agreement for all charges for a Kauai man charged with sexual assault.
Tarey Low, 56, of Kapaa, was found not guilty Monday on four of the 23 charges of sexually assaulting a female minor from June 29, 2007, through Feb. 14, 2014.
A status hearing was set for Sept. 20 to determine the logistics of retrying him on the remaining 19 charges. The hearing will also address any motions the state or defense attorney may need to make.
Low appeared somber with his hands folded as the judge addressed him on day six of the jury trial.
Outside the courtroom after the ruling, nearly a dozen family members and supporters of Low hugged, while a few wiped tears from their eyes.
Low is a former Kauai police officer and state Department of Land and Natural Resources Division of Conservation and Resources Enforcement officer.
The jury deliberated for seven hours Friday afternoon and Monday morning before coming to the partial verdict.
