LIHU‘E — Victor Aguilar, a 65-year-old Kalaheo man, was arrested on Thursday on a grand-jury indictment charging five counts of sexual assault in the second degree for allegedly sexually assaulting a former student at Waimea High School.
LIHU‘E — Victor Aguilar, a 65-year-old Kalaheo man, was arrested on Thursday on a grand-jury indictment charging five counts of sexual assault in the second degree for allegedly sexually assaulting a former student at Waimea High School.
Bail is $1 million.
The case began with a state Department of Education investigation involving alleged misuse of electronic devices issued to Aguilar by the DOE and the U.S. Army, according to a county press release.
The Kaua‘i Police Department was notified of the DOE investigation’s initial findings. Detectives later obtained and executed search warrants for several DOE-issued electronic devices as well as electronic-storage devices and a cellphone from Aguilar’s residence.
Aguilar resigned his position as the JROTC senior Army instructor at WHS after being notified of the initial findings of the DOE investigation.
Deputy Prosecuting Attorney Keola Siu is prosecuting the case.
An indictment is an accusation of charges returned by a grand jury. Indicted persons are presumed innocent until proven guilty beyond a reasonable doubt.
Justin Kollar, county prosecuting attorney, said he cannot say too much about this case because it is still pending.
However, he was able to talk about what he and his team anticipate will happen in the proceeding.
“We expect the evidence at trial will show that the accused is guilty of the crimes he is charged with,” Kollar said.
The KPD investigation is ongoing.

This is a slam dunk case for the defense. What would Mickey Haller do?
He would try to discredit the prosecution by calling it circumstantial evidences. Then try to base his clients on hearsay and unfounded facts based on someone’s opinion rather than true evidence. This community already is biased towards family. The defense needs to color the area to black and white then to gray. The defense will claim the basis of an athlete. His glory and his fame. Public opinion of him already shades it gray. The defense will try make prosecution dismiss all charges. However the bail at $1 million dollars would need to be paid first. A good trial.
