LIHU’E — Kaua‘i Fifth District Court Judge Michael Soong denied a decrease in bail for a Utah man charged with violating Hawai‘i’s mandatory 10-day quarantine four times since arriving on Kaua‘i Dec. 28.
David Barnes, 50 of Bountiful, Utah, who arrived at Lihu‘e Airport on Dec. 28, after traveling from the Mainland, has a bail that remains at $10,000.
Barnes’ supervised release was also not recommended by state prosecutors because Soong stated, the court had concerns that he was considered a “flight risk” and he was labeled a “danger to the community.”
Barnes is currently being held on misdemeanors.
Barnes violated government orders three times and was accused of trespassing on the Kaua‘i Marriott grounds.
Barnes’ attorney Renee Arndt attempted to argue with Soong and pointed out that his bail is excessive because his charges were only misdemeanors.
Arndt argued that Barnes’ incarceration has caused him to struggle with mental health issues.
The type of mental health issues Barnes suffered from wasn’t specified on the court record.
Barnes filmed 83 TikTok videos of him violating quarantine, and he tagged the Kaua‘i Police Department in the videos.
During the videos, he was shown violating the rules and making disrespectful references to the island.
“(The rules are) really f***ing stupid, but, these are the rules, and I do not want to go back to jail,” he said while breaking the rule.
In another video, Barnes films himself headed to Duke’s Kaua‘i, mocking the island’s rules and the 10-day quarantine.
“That bar kicked me out because I told them I was quarantining and I was just getting some exercise, but I was trying to be honest, and they told me to bounce, so I did,” Barnes said in one video. “I just want to have a beer and kickback. (Kaua‘i) is tyranny. Kaua‘i is a communist party, and I am a Chinese Spy on TikTok.”
Barnes’ next hearing will be held in criminal court at 8 a.m. on Jan. 26.

I am ashamed of this behavior and the shadow it casts on all visitors to the island that I love and long to return too. I will donate $100.00 toward a plane ticket to get this guy escorted off the island by police. I would hope that other visitors would join me so the people of Kauai can be ride of this s***bag of a person.
