The Planning Committee will consider a bill for an ordinance amending the county code related to enforcement, legal procedures and penalties.
The purpose of this bill is to “strengthen existing mechanisms to assist the Planning Department with its enforcement of the codes, statutes, and regulations that it has the authority to enforce. The proposed revisions and additions will better enable the Department to, among other things, “Place a lien on property where the owner has refused to rectify the violation or pay their civil fine within 30 days of the County’s notice of violation and order.”
The Planning Committee will also consider an amendment that would expand the permissible uses of the Public Access, Open Space, Natural Resources Preservation Fund to include paying for improvements to lands or entitlements acquired by the fund, and to improving existing public beach accesses.
In the Nov. 6 general election, Kauai voters passed a proposal to amend the county charter to permit the fund to include improvements.

Government plays a very important role in the administration of a functioning Society. The problem is that Government also has a tendency to feed on the people by doing things that may end up taking away freedoms and property unfairly. I would vote “no” for the power to affect, or even drive a home owner away, from a property and home that they earned over many years and have the rights to enjoy. Property owners are taxed heavily already and adding or taking yet another Government power against home owners seems excessive.
These things start with good intentions but morph into monsters. It starts with the ability to regulate bnbs, but the county can fine you for having 2 sinks, too many bedrooms, a fence that is too tall, having a firepit, a fireplace, an unkempt yard. Where does it end. If it’s only for b&b make it specific not generic.
