The Gateway Project cost as of July 2003 $ 6,517,663, projected cost as of June 2000 $ 5.4 million, irrigation system bid $450,124.46 makes the project $1.6 million or about 30% over budget.
Conditions: County provides volunteers to maintain the project. Problem: The County did run out of volunteers. Solution: Forced Labor a.k.a. prison labor or inmate work = involuntary volunteers. Difficulty: No work equipment / tools available. Solution: Have tools donated from somebody.
Problem: The communication (C2004-41) combines the donation, with the work (forced labor), with the Gateway Project and with the inmates.
There is no trouble with a donation of tools to KCCC. The ethical difficulties are at the forced labor. “U.S. Courts cases have held that while inmates do not have a constitutional right to prison employment, they do have a right to conditions that do not include stultifying idleness”. The basic question is can inmates volunteer or are they volunteered. Why gets inmate #1 a field trip, and inmate #2 gets the same trip denied? Other questions remain open: How a project can run close to 30 percent over budget. In addition, those who are in charge of the budget stating it looks nice. The 30% over budget or the visual appearance of the project or both? No questions asked? Why?
This is not about the donation of 100 pairs of gloves, I appreciate Mr. Yoshioka’s donation to KCCC. This is about the ‘Creative Funding’ in this County. Are we ready to return $5,214,130 + to the Federal Government?
