A jury found Arthur Duncan, 53, of Kapa’a, guilty of the felony offense of terroristic threatening after a two-day trial at Circuit Court in Lihu’e, according to county prosecutors.
The jury members returned their verdict last week after an hour of deliberating.
On July 14, 2004, Duncan and the victim got into an argument about a coconut at Lydgate Park in Wailua, prosecutors said.
Duncan threatened the victim with a machete during the argument, according to prosecutors.
Duncan, who has prior convictions for terroristic threatening, prohibited ownership of firearms, unauthorized control of a propelled vehicle, auto theft, six counts of assault, and two counts of driving under the influence of an intoxicant, faces five years imprisonment.
Members of the jury found Duncan innocent of a misdemeanor assault charge.
Deputy Prosecuting Attorney Jennifer Winn represented the state. Caren Dennemeyer represented Duncan. Judge Kathleen Watanabe presided.This was the first jury trial in the new judiciary complex.
