The 17-year-old boy who allegedly drove the car from which multiple gunshots were fired near the Kapa‘a McDonald’s in late June will have a chance to tell his side of the story at his preliminary hearing in District Court, Dec. 10.
Yesterday’s scheduled hearing was delayed until then.
A representative of the law firm Hempey and Meyers, representing Brock Alan Reyes, of Kapa‘a, confirmed the continuation yesterday.
In August, 5th Circuit Family Court Judge Calvin Murashige determined the seriousness of the charges against Reyes — first-degree attempted murder and other felonies — as well as his lack of mental illness and proximity to legal adulthood warranted a full trial as an adult rather than further incarceration as a minor.
Reyes was picked up on June 27, along with 26-year-old Taekyu U, reportedly a family member of Reyes’,
in the vicinity of Lydgate Park in a vehicle fitting the police dispatch description of one leaving the scene of the shooting just minutes earlier.
At U’s two-day preliminary hearing in District Court in July, Officer Vernon Scribner testified that he saw a labeled box of CCI Blazer ammunition in plain view between the driver and passenger seats, and officer Charles Dubocage testified that he found a Lorcin .380-caliber semi-automatic pistol protruding from under the passenger seat.
U, who was seated in the passenger seat when the car was pulled over, pleaded not guilty to charges of first-degree attempted murder, carrying or use of a firearm in commission of a felony, unlawful place to keep ammunition, unlawful place to keep a pistol, and possession of a prohibited deadly weapon, reportedly a set of metal knuckles, at his July 31 arraignment in 5th Circuit Court.
His trial is scheduled to begin on Dec. 8, two days before Reyes’ hearing.
Neither U nor Reyes remain in custody.
Bail had been set at $250,000 for U, the alleged shooter, and $50,000 for Reyes, the alleged driver.
