HONOLULU — The state Department of Health’s Office of Solid Waste Management has signed a settlement agreement with Garden Isle Disposal Inc. for violations of Hawai‘i’s deposit beverage container law.
The department filed an enforcement case against the private company for violations of the program’s certified redemption center laws and assessed a total penalty of $41,110 against Garden Isle Disposal, a news release states.
From Aug. 1, 2005 through March 23, 2006, Garden Isle Disposal used an unapproved segregated weight value per pound to calculate redemption value by weight for plastic deposit beverage containers. Garden Isle Disposal used the unapproved rate to calculate deposit reimbursements and handling fee claims submitted to the department on monthly DR-1 and HR-1 report forms.
In fulfilling its obligations under the settlement agreement, Garden Isle Disposal has paid a cash penalty of $15,216. Additionally, the company has paid $15,000 to fund a supplemental environmental project.
Garden Isle Disposal provided funding to Garden Isle Resource, Conservation & Development for the Zero Waste Kaua’i project. The supplemental environmental project funds will be used to expand the nonprofit’s education efforts and increase its assistance to others to maximize waste diversion.
Garden Isle Disposal has not denied responsibility for the violations stated in the enforcement case, the release says.
