LIHU‘E — Attorneys are continuing to negotiate a plea agreement in the year-old McDonald’s Waipouli Town Center drive-by shooting case, said defense attorney Daniel Hempey.
Hempey, who represents Brock-Alan Reyes, 18, of Kapa‘a, said his request to have Reyes’ charges dismissed and to separate the charges from co-defendant Taekyu U was continued until Aug. 13.
U, 27, of Kapa‘a, was represented in Fifth Circuit Judge Randal Valenciano’s courtroom in the Lihu‘e state courthouse by Michael Green, an O‘ahu attorney who participated in Tuesday’s proceedings via telephone conference call.
Both U and Reyes are charged with first-degree attempted murder and firearms violations in connection with a drive-by shooting at the Waipouli Town Center McDonald’s.
It remains unknown whether the men were firing at someone specific, either a restaurant employee or patron. No one was injured.
Lori Wada, first deputy prosecuting attorney in the case, could not be reached for comment by press time.
Hempey’s motions to dismiss and sever are based on his contention that Reyes, who was a minor at the time of the indictment, should have first been referred to juvenile court, and that prosecutors erred in charging both U and Reyes with the same charges together, not separately.
