LIHU‘E — Two judges issued bench warrants for a man who missed sentencing hearings in two cases.
Preston McCain, 39, of Lihu‘e missed a sentencing for third-degree assault and second-degree terroristic threatening on Wednesday in 5th Circuit Court. His attorney, Caren Dennemeyer, said the defendant was reportedly the victim of a stabbing on Feb. 27, and asked for a continuance until his status could be confirmed.
Judge Katherine N.A. Watanabe ordered a bench warrant in the amount of $5,000, for missing the hearing and for not maintaining contact with his attorney.
McCain also failed to appear for sentencing a week earlier before Chief Judge Randal Valenciano on March 15. McCain entered a no-contest change of plea to a third-degree assault charge on Feb. 2, when Valenciano informed him of the sentencing date.
Dennemeyer informed the judge that the stabbing incident might have been a factor, but her request to stay the bench warrant was denied and a bench warrant was issued for $1,000 along with $5,000 for the underlying charge.
