Judge Kathleen Watanabe postponed the deferment hearing until Jan. 30, 2013. It was postponed to allow him to testify at the trial of the only co-defendant of four who did not to plead guilty in the matter.
Ka-Ne was one of four defendants tried separately for the Jan. 4 robbery of a Koloa service station and convenience store. Each was charged with first-degree robbery and attempted second-degree theft.
Mason Noah Saio, 20, of Kalaheo, is the only defendant that did not accept a plea deal. He also faces attempted second-degree theft and third-degree assault charges and remains in custody at Kaua‘i County Correctional Center.
Ka-Ne is slated as a witness at Saio’s trial that
is scheduled to begin on Dec. 3.
Ka-Ne pleaded guilty to an amended charge of second-degree robbery on June 18. He was granted supervised release and is requesting a deferred acceptance of his guilty plea, which could remove felony charges from his record after completing probation.
A third co-defendant, Josiah K. Kaluna, 18, of Koloa, pleaded guilty to second-degree robbery and fourth-degree criminal property damage on June 20. He is scheduled to be sentenced on Oct. 3.
The fourth co-defendant, Kalai Hans Vicente, 19, of Kapa‘a, pleaded guilty to an amended charge of second-degree robbery on July 5 and is scheduled to be sentenced on Oct. 10.
