LIHU‘E — In 5th Circuit Court on Wednesday, Judge Kathleen Watanabe issued a $10,000 bench warrant in the matter of Kaili Ragudo after the defendant failed to appear for her deferment of sentencing and drug court application hearing.
Ragudo was arrested on July 26. The September indictment included charges of third-degree promotion of the dangerous drug methamphetamine and for unlawful use of drug paraphernalia. She pleaded guilty to the felony meth charge on June 18.
The hearing on the decision of a deferred acceptance of the guilty plea was continued on Sept. 19 and Oct. 3, as defense attorney Scott Kessinger requested more time to assist Ragudo in her application for Drug Court. The attorney said Wednesday that neither he or the probation department has had any contact with the defendant.
Second County Deputy Prosecuting Attorney Samuel Jajich represented the state.
One-year deferred sentences were granted for Scott Sagum in a third-degree assault case, and to Cyris Paul Dorotea Dela Cruz, 22, of Waimea, for second-degree unauthorized entry, trespassing and theft charges.
In Sagum’s case the deputy prosecutor Gary Nelson went so far as to recommend against any mandatory minimum jail time and was in favor of the deferment. In Dela Cruz’s case, the judge issued a $250 fine.
On Tuesday in Chief Judge Randal Valenciano’s court, Braven K. Kight, 23, of Kapa‘a, pleaded guilty to first-degree assault. The class B felony carries a possible 10-year jail sentence.
The assault occurred on March 17, when Kight allegedly stabbed Eddie Perez twice in the shoulder as he sat in his vehicle. His sentencing date is set for Jan. 31, 2013.
Lani Clark, 28, of Kapa‘a, pleaded no contest to second-degree drug charges, mutual affray and drug paraphernalia charges. His sentencing is set for Jan. 31, 2013.
Clark also entered a no contest plea to burglary and second-degree theft in Watanabe’s court in another case. Sentencing is set for Feb. 6, 2013.
Charges against Clark’s co-defendant’s, Sebastian Ujano and Jeremy Noble, are scheduled to be dismissed on March 30, 2013.
A $10,000 bench warrant was issued for Mark Chandler, 50, of Kilauea. He failed to appear for his trial setting hearing, where there was also stayed bench warrant that was issued for not appearing for an Oct. 9 hearing.
Etienne Trillo, 22, of Anahola, failed to appear in Watanabe’s court on Tuesday. She did not issue a bench warrant after declaring a conflict with the court, and set a hearing date of Oct. 30 before Judge Valenciano.
Sione G. Napaa, 28, of Hanama‘ulu, pleaded no contest to an amended count of third-degree unauthorized entry. Watanabe sentenced the defendant to time-served, approximately four-and-a-half months.
