LIHU‘E — Smashing a car window with people inside cost a Kapa‘a man jail and probation in 5th Circuit Court.
Over two days in two courts Sean Luca Cruz-Kamanuwai, 23, of Kapa‘a, was sentenced to 90 days jail and a five-year felony probation Wednesday on theft and criminal property damage charges in Judge Kathleen Watanabe’s court.
On Thursday he was sentenced to 180 days jail and a five-year felony probation for second-degree theft and abuse of family or household member in Chief Judge Randal Valenciano’s court.
The sentencing was ordered to run concurrent in both courts.
Cruz-Kamanuwai was arrested March 3 for two counts of family abuse and third-degree criminal property damage. He entered a no-contest plea on Aug. 7 to felony second-degree criminal property damage.
State Deputy Public Defender Christian Enright said the defendant has no prior felony convictions and a DUI misdemeanor in his criminal history. He recommended the approximately nine months time served in jail and probation with an assessment for substance abuse and domestic violence intervention.
The defendant and the victim are no longer in a relationship, Enright said.
County Deputy Prosecuting Attorney Lisa Arin said the defendant took a rock and shattered the rear window of a vehicle, with his girlfriend and her two children sitting inside.
She said the defendant is facing two domestic violence cases in the plea deal asked for six months jail with probation.
Judge Kathleen N.A. Watanabe ordered Cruz-Kamanuwai to pay $5,096.93 in restitution to the insurance company that was involved in covering damage in the crimes.
