Protesters breaking the law, KPD failing to do job
The legal definition paraphrased is: “any person who intentionally restricts another’s freedom of movement without their consent, even momentarily, may be liable for false imprisonment, which is both a crime and a civil wrong.”
Clearly, the protesters on the North Shore have no legal standing or authority to stop, delay or impede those using public highways, yet they did so, and continue to do so. Why haven’t they been arrested or at least cited?
Standing in front of a car so they can’t proceed, even without causing physical harm, is a classic case of false imprisonment. KPD is not doing their job. Arrest and cite these lawbreakers. The law applies to, or should apply to, everyone equally. Further, I wouldn’t be surprised if one of the people who were stopped by these morons sued them civilly for false imprisonment, and rightly so. They would certainly be squarely within their rights to do so.

They aren’t being charged because that is NOT false imprisonment. They were blocked from driving forward, yes, but no one restrained them or blocked them from reversing their car and going in the opposite direction. If the tourists were restricted from movement in all directions, then a False Imprisonment charge would be valid
Sorry, Wailua, you are wrong. If you cannot move “freely”, ie the direction you want to go, then it is false imprisonment. “False imprisonment occurs when a person (who doesn’t have legal authority or justification) intentionally restrains another person’s ability to move freely”
Mr.Travis: I am in full agreement with you. I am not sure if they are still protesting on the North side, but if those fools tried to stop me, I would assuredly let them know that they are in the wrong. I hope things have calmed down and those sign holders with plenty of time on their hands have returned to knitting pot holders and dream catchers.

James, you are absolutely correct. If we did this ini Kalaheo, Lihue, any other town on the island, we would be approached by KPD.
Why does KPD avoid the north shore? Afraid of confrontation? No real police presence since they moved their operations out of the Hanalei Sub-station and moved their people to Kapaa?
Why did they move to Kapaa when the main police station is just 7 miles away? Hanalei is left without a real police response as it is over 20 miles away in Kapaa.
Maybe that is the reason they do not address the problems on the north shore

False imprisonment or not, they are creating a potential safety issue by standing or walking in the middle of a roadway. Drivers are being detained in their vehicles for a period of time by someone not authorized to do so and without suspicion or cause.
Imagine this happening on the highway in Lihue or Kapaa.
