LIHUE — A trial was set in Fifth Circuit Court Tuesday for Jonathan Reed Carvalho, 40, who is charged with the unauthorized entry into a dwelling.
Carvahlo, who had not been arraigned in lieu of a capacity and fitness to stand trial examination in early June, pleaded not guilty to the allegations, but last week he was found fit to stand trial.
“I would ask the court to set this matter for a jury trial,” attorney Samuel Jajich asked the court.
After a bench conference, Jajich asked the court to set an interceding pre-trial conference for Wednesday and requested a status hearing be scheduled for Monday. Both requests were granted.
Charging documents state Carvalho intentionally entered a home with an incapacitated resident in the 4000 block of Ekolu Street on or about May 25.
An examination to determine fitness and capacity was ordered in early June and on July 2, Carvalho was found unfit to proceed in the judicial process and he was ordered to be admitted to HSH for restoration.
On Sept. 4, a second examination to determine fitness was ordered and on Oct. 16, Carvalho was found fit to proceed in the judicial process.
Carvalho’s trial was scheduled for Feb. 19, with bail set at $5,000.
Fifth Circuit Court Judge Kathleen Watanabe presided over the hearing.

Um, Bethany, you forgot to mention that he was buck a$$ naked, with clothes and shoes in hand while intruding in the victim’s home. Thank goodness the victim caught him on her home surveillance system. God knows what else he had in mind????!!
This guy has been a nuisance to the community for years. Lock him up before he seriously hurts someone.
