LIHUE — A hearing for a man accused of burglarizing Coco Palms was continued one week after the state requested additional time to present evidence against him.
Darren Dean White, 46, appeared before Fifth Circuit Court Judge Kathleen Watanabe Monday to hear the state’s motion to increase bail from $10,000 to $100,000.
It had been previously continued one week when White had failed to appear. The state had said then it was ready to proceed.
Defense Attorney Shauna Lee Cahill argued the state failed to present sufficient evidence in its motion calling it “hearsay” unless the state could produce “actual witnesses in the court to testify.”
The state then requested a one-week continuance.
“The state was prepared to argue the motion today, but more time would allow us to appropriately address counsel’s concerns,” said Prosecuting Attorney Justin Kollar. “The state plans to adduce the necessary evidence at the hearing to establish that Mr. White’s current bail is too low.”
White is charged with one count of burglary in the second degree, possession of burglar’s tools, theft of copper, restriction on possession, sale, gift or delivery of electric guns.
According to the state’s motion, White was found at Coco Palms with a stun gun in his pocket. He allegedly had been attempting to steal copper wire with the help of an accomplice.
The state’s motion further alleges that while out on bail, White was again on the property and then charged with burglary in the second degree.
The hearing is continued to 9 a.m. Nov. 18.
