LIHUE — A construction zone accident has led to a lawsuit seeking medical and other damages.
Narciso Nicolas, of Honolulu, is suing William Waialeale and his employer, Robert’s Tours and Transportation, Inc., for injuries incurred while working on Kokee Road in 2012.
On Nov. 15, 2012, Narciso was working in a construction zone on Kokee Road when he went to put his utility belt away in the company truck that was parked inside an area coned off from traffic, according to the suit filed Nov. 14 in 5th Circuit Court. The defendant, Waialeale, was driving a Robert’s Tours bus down Kokee Road, and failed to stay inside the designated construction bypass lane when, according to the complaint, he crossed into the coned-off area and pinned Narciso between the tour bus and the company truck.
The suit is charging Waialeale and Robert’s Tours with negligence and is seeking payment for medical and therapeutic services and other damages. Workman’s compensation medical payments incurred exceeded $5,000.
No hearings have been filed.
