The Kauai County Council voted 5-1 Wednesday to appeal a federal judge’s ruling that Ordinance 960 related to pesticides and genetically modified crops is pre-empted by state law, and therefore invalid.
The cost of appeal has been capped at $12,750 after the county’s special counsel offered to waive all fees moving forward.
“I can find no good reason not to support this modest amount of money,” said Councilman Gary Hooser, adding that the county’s hired law firm is “putting their money where their mouth is.”
Councilman Ross Kagawa cast the lone dissenting vote.
