LIHUE — The Lihue woman re-indicted as the driver in a fatal 2011 accident pleaded not guilty Tuesday.
Brittney Lehua Kane, 20, was arraigned in 5th Circuit Court on charges of manslaughter, first-degree negligent homicide, second-degree assault and first-degree negligent injury.
The original case was dismissed in February on grounds of prosecution error. The court ruled that the prosecution failed to file the proper court orders that would have transferred the case from family court where it originated when Kane was 16 years old.
But a grand jury issued a new indictment on the charges March 12.
Judge Kathleen Watanabe set a trial date of Aug. 18.
Kane’s charges stem from an accident that occurred Sept. 11, 2011. She is accused of driving a vehicle in a negligent manner while under the influence of drugs or alcohol.
Kane was allegedly driving after attending a hotel party when her car left the road and overturned after striking a tree. Her passengers, Nahele Kapua, died, and another passenger, Koahe Cordeiro, was seriously injured.
