A Waimea man will serve a year in jail and five years of felony probation for an assault with a pellet gun.
Joseph A. Lopez III, 46, entered a no-contest plea Tuesday to second-degree assault in 5th Circuit Court. The charge is a class C felony with a maximum possible sentence of five years in prison and a $10,000 fine.
Lopez was charged with recklessly causing substantial bodily injury to someone on Nov. 16, 2012. A second felony charge that included the use of a pellet gun was dismissed in the agreement.
Judge Kathleen Watanabe said that if Lopez accepted the terms, he would receive five years of felony probation, with conditions that included anger management, a chemical dependency assessment and one year in jail.
Sentencing is July 9.
