LIHUE — A Lihue man accepted a plea deal Thursday that will guarantee a 10-year prison sentence rather than risk 20 years with a trial at 5th Circuit Court.
Alfred Kyle Lopes, aka Alfred K. Lopes, Jr., 30, avoided going to trial on three counts of first-degree sexual assault against a minor who was less than 14 years of age at the time the offenses occurred between Dec. 1, 2009, and Jan. 31, 2010. He pleaded no contest to one amended count of second-degree sexual assault.
County Deputy Prosecuting Attorney Lisa Arin said in court that count two of the indictment was an offense of penetration without stating the gender of the victim.
Two other counts will be dismissed after sentencing, pursuant to the plea agreement.
Chief Judge Valenciano stopped the proceedings at one point when he asked Lopes if he was accepting the plea offer of his own free will and was not trying to protect another person.
After speaking with his court-appointed attorney Caren Dennemeyer, Lopes confirmed that he was accepting the deal and that he did not want to go to trial. Sentencing for Lopes is scheduled for April 17.
Lopes was sentenced to five years in prison in 2005 after losing his probation for vehicle-related felony offenses that he was sentenced on in 2004.
