LIHU‘E — After three years of inactivity, the co-defendant in a 2008 Kapa‘a shooting case has pleaded no contest to a firearms charge.
Brock Alan Reyes, 22, was 17 years old on June 27, 2008, when he allegedly drove a vehicle in the vicinity of the Kapa‘a McDonald’s. A co-defendant reportedly fired shots from the vehicle, and no one was reportedly hurt.
Initially charged as a juvenile in Family Court, Reyes was ordered to stand trial as an adult. His case was moved to Circuit Court on Jan. 20, 2009. A status hearing on a motion to dismiss on Jan. 12, 2010, was the last activity in the case until a change of plea or trial setting was held on March 19, 2013, and continued until Tuesday.
With Chief Judge Randal Valenciano presiding, Reyes pleaded no contest to possessing a .38-caliber Blazer brand ammunition and not storing it as permitted during sojourn or at a residence or place of business.
Four other counts of attempted first-degree murder and three firearms charges are to be dismissed in the agreement.
Defense attorney Dan Hempey entered a motion for deferred sentence. If approved at the July 11 sentencing hearing, the charges could be removed from Reyes’ permanent record upon successful completion of a felony probation.
County Deputy Prosecuting Attorney John Murphy represented the state. The plea notes that the state would not object to probation and offered no recommendation on the deferment.
The alleged shooter, Taekyu U, 30, of Kapa‘a, was 25 at the time of the incident.
His first-degree attempted murder charge was amended and he pleaded guilty to first-degree reckless endangering. He also pleaded guilty to three firearms charges, both A-and-B felonies, and one misdemeanor, and another C felony weapons count.
Valenciano sentenced U to 20 years in prison on Dec. 31, 2009. He is currently housed at the Saguaro Correctional Center in Arizona, under contract with the Hawai‘i Department of Public Safety, with a scheduled release date of Dec. 21, 2029.
