LIHU‘E — After having his probation revoked for violations, a Lihu’e man was sentenced to five years in prison Tuesday for drug charges in 5th Circuit Court.
Akeakamai Kealoha Nino, 22, was in custody for violating a probation term on charges of using and selling methamphetamine and oxycodone while on probation for other matters. He was facing re-sentencing in a global plea deal involving old and new drug and firearm violations.
The full five-year prison term is appropriate after the court has exhausted the opportunities of drug court and probation for the defendant, said County Deputy Prosecuting Attorney Timothy Tobin.
Judge Kathleen Watanabe said the defendant has been afforded ample opportunities to change without heavy prison time. The revocation of probation and new charges indicates a substantial non-compliance, she said, and sentenced him to five year terms for the felony methamphetamine charge and place to keep an unloaded firearm.
The court granted State Deputy Public Defender Stephanie Sato’s request that the defendant be granted credit for time served, and that his prison term run concurrent with other sentencings.
Nino said that he was sorry for ruining his chances and probation and said he was ready to take responsibility for his actions.
