LIHU‘E — A Kapa‘a man was sentenced to 180 days and probation for failing to comply with state sex offender registry requirements Wednesday in 5th Circuit Court.
Brian Kelepine Lopes, 56, has already served 220 days while awaiting trial on 21 charges of failing to register within 30 days of his birthday. He entered a no contest plea for two of the felony charges on Aug. 21.
State Deputy Public Defender Christian Enright said the defendant, like others arrested in the sex-offender non-compliance sweep earlier this year, was confused with the change in the law this year regarding reporting requirements. State sex offender registry requirements also dictate that if you are homeless, to report to the Kaua‘i Police Department on a monthly basis.
The defendant has not been in trouble for the 12 years since getting out of jail, Enright said.
County Deputy Prosecuting Attorney Lisa Arin said the defendant had signed forms stating he understood the changes.
Judge Kathleen N.A. Watanabe ordered a five-year probation and time-served. She also ordered a substance abuse evaluation.
