LIHU‘E — Sex offender registry compliance violations, domestic violence, drugs and burglary sentencings led the calendar Thursday in 5th Circuit Court.
Stanley Miguel, 63, of Hanapepe, was arraigned on an Oct. 12 indictment charging him with 15 counts of failing to comply with covered sex offender registration requirements since February, 2011.
Chief Judge Randal Valenciano set Miguel’s trial date for Feb. 4, 2013. He remains in custody at Kaua‘i County Correctional Center with $45,000 bail.
Christian Raven Wood, 21, was sentenced to 30 days jail and five years probation for a first-degree burglary of a Kilauea residence in August. The sentence was also for a third-degree assault and fourth-degree property damage charges against at the residence.
Wood received a 90-day sentence and another five-year probation for a second case that involved a re-sentencing for an unauthorized entry into a dwelling charge.
Defense attorney Dan Hempey said the charge was not for illegally entering a residence. The defendant was invited in by a friend and refused to leave when a woman with whom he had had a past relationship arrived and asked him to leave.
Valenciano said the there were two incidents. He ordered the defendant to take domestic violence intervention and to undergo an alcohol and drug addiction assessment.
Garrett Taylor Aukai Naumu, 28, of Lihu‘e, had his reduction of sentence hearing continued to Nov. 1. It will follow an October hearing to consider his request to be admitted to Drug Court in another case.
Misty Pualani Meiling Pacheco, 28, of ‘Ele‘ele, was sentenced to a five-year probation, with credit for 155 days already served at KCC awaiting trial, and $300 in restitution to the property owner for a second-degree burglary in April.
Valenciano denied the deferment of the sentence and said the charge should be on Pacheco’s permanent record.
The court did grant a deferment in the case of Kitty Lee Freitas, 37, of Lihu‘e, who received a one-year probation for inattention to driving.
Freitas was reportedly in her vehicle on Dec. 21, and was attempting to end a relationship with a male companion, when police arrived to arrest the man on an outstanding warrant, according to defense attorney Rosa Flores.
The defendant did not know the man was wanted, Flores said, and agrees that she acted inappropriately with officers and should have addressed her complaints with them at a later time.
Austin Ahia Arthur, 26, of Kekaha, was sentenced to five days jail and two-years probation for an abuse of family or household member charge. Arthur was arrested Jan. 5 and changed his plea to no contest on July 26.
Deputy Prosecuting Attorney Gary Nelson said the state asked for a five-day minimum sentence instead of the mandatory two-days. The defendant struck the woman in the back seat of the car with their three-year-old child watching as she sustained injuries.
Valenciano said that a father is a role model for a child. If a three-year-old girl witnesses the father striking her mother, then it is possible that she will expect that same behavior against her later in life, he said.
The case against Tasha Nicole Fletcher was dismissed without prejudice as the trial date approached next week. Fletcher, 29, of Lihu‘e, was arrested Jan. 20 for second-degree assault.
County Deputy Prosecuting Attorney Melinda Mendes said the office has lost contact with a key witness. The court denied the defense request to dismiss with prejudice.
