LIHU‘E — A Kilauea man was declared unfit for trial and will remain at Hawai‘i State Hospital pending a review hearing in 5th Circuit Court this November.
Richard Frederick Ryan, 49, appeared Tuesday via video conference with staff of Kahi Mohala Behavioral Health on O‘ahu.
He has been held at the facility since an April 9 hearing when he was declared unfit for trial a third time.
Chief Judge Randal Valenciano said the court would take judicial notice of a three-panel review that was unanimous in declaring Ryan unfit to proceed. He ordered a 60-day review hearing to determine whether Ryan could at some point be reconsidered as being fit for trial.
County Deputy Prosecuting Attorney Melinda Mendes represented the state.
State Deputy Public Defender Christian Enright represented the defendant.
Ryan was indicted on March 3, 2010. He was released on bail but did not make any more appearances until he was arrested again in Hanalei on Oct. 20, 2011.
He was wanted on outstanding warrants of failure to appear and violating terms of bail.
His original charges are for first-degree terroristic threat and fourth-degree theft.
At the conclusion of the hearing, Ryan said that he would maintain his not-guilty plea and asked the court for a jury trial upon his restoration of fitness.
Valenciano said the court could not consider another fitness for trial motion or set a trial date until the restoration issue is handled at the Nov. 15 review hearing.
