LIHU‘E — Three sentencings Wednesday in 5th Circuit Court highlighted the consequences of repeat offenses and failed probation.
Kelly Ray Yadao, 40, of Kaneohe, was sentenced to two five-year sentences to run concurrent for a 2010 check forgery case and a 2012 methamphetamine charge.
Judge Kathleen Watanabe told Yadao to do good time and to learn from the experience. She allowed the two new terms to run concurrent with another five-year sentence that Yadao received recently after failing probation in another older case.
Aaron Fowler, 44, of Lihu‘e, was sentenced to five years for a second-degree burglary charge, and re-sentenced to five years for failing probation for a 2010 second-degree escape conviction.
Watanabe said that Fowler has had several opportunities and that after failing to comply with probation and reoffending, the court had no other option than the open term.
The sentences will run concurrent.
Brian Jaime, 30, of Anahola, was denied a deferment and sentenced to time served and a one-year probation. He was convicted of second-degree terroristic threatening and entered a no contest plea.
Brendan Alakai Duarte, 28, of Kapa‘a, was sentenced to concurrent terms totaling five years in five cases of felony unauthorized control, firearms possession, methamphetamine and terroristic threatening.
Watanabe said the open term was for parole violations in other sentencings, and for failing to comply with probation in another matter. She said the court had to balance the sentence with public safety and encouraged Duarte as a young man to take advantage of drug treatment and to succeed should he receive another parole.
Duarte will be sentenced on other cases today before Chief Judge Randal Valenciano.
