LIHU‘E — Guns, drugs, theft and driving without a license led sentencing matters on Wednesday and Thursday in 5th Circuit Court.
On Wednesday in Judge Kathleen Watanabe’s court, a Kapa‘a man was sentenced to a five-year probation and fined $1,000 for second-degree forgery. The judge said the 77 days already served in jail would be sufficient with the probation.
Justin Charles Doudt, 35, was ordered to pay restitution to the victim and was given an additional $500 fine for third-degree theft. He must also have an drug assessment.
Roddy Cachero, 31, of Hanapepe, will serve his 40-day sentence under home detention with a monitor for driving without a license. The judge granted the request because she said Kaua‘i Community Correctional Center is not able to accommodate his need for ongoing medical treatments.
Cachero paid off more than $3,000 in fines going back several years to reinstate his license. The judge fined him another $1,000 for the citation and ordered probation.
On Thursday in Chief Judge Randal Valenciano’s court, an ‘Ele‘ele man pleaded no contest to fourth-degree promotion of a harmful drug.
Andrew K. Hall, 45, accepted the amended charge that was reduced from a felony to a petty misdemeanor offense. Two other felony charges were dismissed in the deal and sentencing is set for Nov. 8.
John Henry Mattos, 38, of Kekaha, was arrested on Nov. 27, 2010, for two counts of possessing a loaded firearm, violating hunting hours and other restrictions.
His attorney Mark Zenger motioned for dismissal of the case after the prosecution failed to bring the case to trial on June 28. The motion to dismiss with prejudice was approved as a violation of the right to speedy and public trial.
County Deputy Public Defender Melinda Mendis said the state would not appeal. She said that evidence belonging to Mattos would be returned with the exception of a firearm that was reportedly thrown from the vehicle in violation of the law.
