LIHU‘E — A 5th Circuit Court Judge said that selling drugs requires a different approach to sentencing.
Guy Terrence Gillette, 74, of Kapa‘a, was sentenced Tuesday to five-years probation and 30 days in jail. He will also forfeit his gun collection to the state as a convicted felon.
Chief Judge Randal Valenciano said Gillette had a business operation and chose to accept the risks in favor of the benefits. He said the court must respond with a sentence that discourages him from taking that risk again.
Gillette, 74, of Kapa‘a was arrested Aug. 30 for drug paraphernalia, second-degree promotion of a dangerous drug and third-degree promotion of a detrimental drug.
He pleaded no contest on Feb. 23 to an amended charge of third-degree promotion of a dangerous drug.
The state dismissed the remaining counts.
County Second Deputy Prosecuting Attorney Samuel Jajich said the defendant was cooperative with police and the prosecution. The felony conviction resulted in a court order for Gillette to surrender his .22-caliber pistols, two 12-gauge shotguns and a 9 mm pistol.
The sentencing was continued from May 17, where Soong pointed out that Gillette, a transplant recipient, did not have his medications. Rather than allow Gillette to self-report, the judge continued the matter.
