Moniz Jr. is charged on five counts of first-degree sexual assault and two counts of third-degree sexual assault. Third-degree sexual assault is a Class C felony and carries a maximum penalty of five years. First Deputy Prosecutor Jake Delaplane inadvertently stated Moniz was charged with two counts of second-degree sexual assault.
