LIHU‘E — 5th Circuit Judge Randal Valenciano has sentenced Tiffany Anne Moore, 40, of Kapa‘a, to five years in prison on theft and forgery charges.
But the more challenging portion of the sentence in terms of doability won’t kick in until 90 days after her release.
She has vowed to pay at least $250 a month in restitution to the victim in this case, which in the total amount of $75,233.91 will take her at least 25 years to pay back at that rate.
Moore opted for instant sentencing from Valenciano rather than waiting the estimated 11 weeks it takes to prepare a pre-sentencing investigation.
“Immediate sentencing, please,” Moore said.
John Calma, state deputy public defender, said the terms of Moore’s global agreement, or plea agreement, are that several of the other charges in the case would be dropped in exchange for Moore’s guilty plea to second-degree theft and second-degree forgery.
The case involved “a substantial amount of restitution,” Valenciano said.
In court wearing a beige T-shirt with a white T-shirt underneath, and beige pants with leg shackles indicating her current address at Kaua‘i Community Correctional Center, Moore said she had attempted to pay restitution in the amount of around $500 a month, but that the lower payments seem more feasible.
She began serving her five-year term, with credit for time served, immediately after the sentencing hearing Feb. 23.
