Among those present Thursday in Fifth Circuit Court in Lihue for sentencings and plea agreements were: a woman who used stolen credit cards to purchase $1,300 of items at Safeway; a man who was arrested for drunk driving and assault while serving probation for terroristic threatening and family abuse; a burglar eyed by a resident’s surveillance camera; and a woman on welfare who didn’t tell authorities her child had left home until she received almost $6,000 in benefits.
- Kimberly Naholoholo, 34, of Kapaa, was sentenced to a maximum term of 10 years imprisonment with a mandatory minimum term of three years and four months. Naholoholo was sentenced in four separate cases for charges relating to methamphetamine possession, fraudulent use of credit cards, felony theft and forgery.
Naholoholo was last arrested May 7 after using two stolen credit cards to charge over $1,300 in merchandise and gift cards at Safeway. At that time Naholoholo was on bail and pending sentencing for the felony drug offense and awaiting resentencing for violation of probation conditions for a felony theft charge and a forgery conviction.
Naholoholo entered guilty pleas to the credit card and felony theft charges relating to the Safeway incident Thursday. She was arrested for the drug offense by Kauai Police Department officers on Dec. 6, 2002 and entered a guilty plea to the drug offense on Jan. 7.
The mandatory minimum term was imposed based on two prior convictions for felony offenses prior to committing the drug and Safeway offenses.
- Sean Breen, 30, of Hanapepe, was re-sentenced to a five-year term of imprisonment for terroristic threatening in the first degree after his probation was revoked Thursday.
Breen was originally convicted of the felony offense of terroristic threatening and misdemeanor family abuse in 1999. In 1999, he was placed on probation for five years with the special condition that he be incarcerated for one year. Breen was arrested earlier this year for assault and driving under the influence in two separate incidents. Breen also violated his probation by not informing his probation officer of those arrests, failing to pay for his drug testing as ordered, and failing to make scheduled appointments with his probation officer.
- Barrett Belmonte, 20, of Kilauea, was sentenced to a five-year term of probation for burglary in the first degree and attempted theft. One of the special conditions of probation is a one-year term of incarceration. Belmonte entered guilty pleas to the offenses on March 24.
Belmonte was identified as the perpetrator after a Kilauea resident decided to install video surveillance in his home because he noticed that things were missing from his residence. The video revealed Belmonte entering the home in August of last year. Police arrested Belmonte on Sept. 5, 2002 and he admitted to entering the home without permission.
Failure to comply with his probation conditions may result in Belmonte being re-sentenced to a 10-year term of imprisonment.
- Kimi Salvador, 37, of Kapaa, was sentenced to a five-year term of probation for felony theft. Salvador must serve 15 days incarceration as a special condition to probation.
Salvador failed to report that her daughter had dropped out of school, was employed, then moved out of the home, resulting in overpayment of benefits to Salvador.
Salvador entered a guilty plea on Feb. 10. The overpayments were made from March 2000 through July 2001. Salvador agreed to make restitution to the Department of Human Services for the $5,930 in financial assistance, medical assistance and food stamps she received. Salvador paid $2,600 in restitution prior to sentencing as part of the plea agreement.
Failure to comply with her probation conditions may result in Salvador being re-sentenced to a five-year term of imprisonment.
