Fifth Circuit Court cases from Oct. 9:
– As potential jurors were waiting for his case to be called for trial, Arthur Pacheco, 52, decided to plead guilty to a felony charge of theft.
Judge Clifford Nakea accepted the plea and set sentencing for Dec. 13. Pacheco, currently jailed at Kaua’i Community Correctional Center, is facing mandatory incarceration due to prior felony convictions. The maximum possible sentence is five years.
– Tristan Daquioag, 20, of Hanamaulu, pleaded guilty to terroristic threatening, a felony. The defendant admitted to using a machete-bolo-type weapon in a threatening manner at the Nawiliwili seawall in June.
Sentencing was set for Dec. 20.
– Adela Basuel, 30, pleaed guilty to a felony theft charge and requested a deferred plea, which, if granted, would allow her to have a clean record if she complies with court-imposed conditions. A hearing on the motion is scheduled for Dec. 20.
Basuel resides in Oregon.
– Wendy Rivera, 24, of Kapa’a, pleaded guilty to two counts of theft, both felonies. A hearing is scheduled for Dec. 20 on Rivera’s request that the court defer her pleas and give her the opportunity to have a clean record if she complies with court-ordered conditions for a yet-to-be-stipulated period of time.
