Gerard Silva, the man accused of an armed invasion of the Kaua’i County Police headquarters in Lihu’e in March, has been declared fit to stand trial by a three-doctor panel appointed by the court.
Fifth Circuit Judge Clifford Nakea said Thursday that all of the court-appointed examiners believe Silva is mentally competent for a trial, which was set for Sept. 18.
But there was also disagreement on Silva’s mental state at the time of his alleged offense. Craig De Costa, the county’s chief deputy prosecutor, said the judge or jury will decide that, along with Silva’s guilt or innocence.
Silva is charged with attempted murder and terroristic threatening after approaching the police station with a rifle. As he was wrestled into submission by two officers, the weapon fired. No one was injured by the shot.
