years probation on three counts of second-degree sexual assault in connection
with fathering a child with a 12-year-old girl.
One of the conditions for
receiving five years probation is that Asing, who reportedly has been living
with the girl and the infant, must first serve one year in jail, authorities
said.
He could have faced up to 60 years in jail, according to Kaua`i
County deputy prosecutor Shaylene Iseri-Carvalho, but Circuit Court Judge
Clifford L. Nakea assessed the lesser sentence Tuesday.
Authorities said
Asing repeatedly had sexual intercourse with the girl on Kaua’i. She gave birth
to a boy as a result.
The sexual assault charges were filed after the
girl’s grandmother reported that Asing ignored her when she told him repeatedly
that the girl was “just a baby.”
At the time of the sentencing, the victim
and her baby had moved to Oahu to live with the defendant.
Iseri-Carvalho
had argued for a 10-year sentence because Asing knew his victim was an
underaged minor.
“He blatantly violated the law even after he was told it
was illegal. The fact that he has united with the victim and is a father to the
child should not bar him from serious consequences. The ends do not justify the
means,” Iseri-Carvalho stated.
